Foreign Fiancé(e) Overseas?
If the fiancé(e)of a US citizen is living overseas, the foreign fiancé(e) will have to get a K-1 visa. This visa will be required by the fiancé(e) to come into the US to marry his/her fiancé(e), who is a US citizen. After entering the US, the marriage should take place within 90 days of the fiancé(e) entering the US. The foreign fiancé(e) will be in position to apply for a green card once the fiancé(e) and US citizen are married. So, it is basically a two-step process; first getting the K-1 visa and second getting married within 90 days of the foreign fiancé(e)'s entry in the US. If you and your fiancé(e) meet the requirements listed below, we promise to charge only a $800 attorney fee. The K-1 visa can take anywhere between 4 to 8 months to be issued.
Features of Fiancé Visa
- 1 A fiancé(e) visa is for a foreign national who enters the US solely to marry the US citizen fiancé(e). So, a foreign fiancé(e) cannot marry someone else to apply for a green card.
- 2 A fiancé(e) visa cannot be extended.
- 3 A foreign fiancé(e) after entering US cannot change her status. This means that a foreign fiancé(e) cannot change her status from a fiancé(e) status to a student status, investor status, and etc after entering the US.
- 4 If your foreign fiancé(e) is not able to travel to the US, a fiancé(e) visa may be a only option.
- 5 After your foriegn fiancé(e) entered the US with the fiancé(e) visa, she/he would only have 90 days to marry.
- 6 Minor children of foreign fiancé(e) can accompany to the US.
- 7 USCIS may disclose to the foreign fiancé(e) that the US citizen’s criminal history involving sex offenses.
- 8 K visa will not be issued when a US citizen fiancé(e) filed K-1 petitions for 2 or more fiancé(e) and the previously approved petition was filed within 2 years.
- 9 K visa will not be issued when a US citizen fiancé(e) has been convicted of a specified sexual offense against a minor.
Requirements for K-1 visa
- 1 You must be a US citizen. If you have a green card, the K-1 visa is not an option for you. If this is your case, please email me your case information for a free case evaluation to find your other options.
- 2 There are no legal restrictions that prevent you and your fiancé(e) from getting married.
- 3 You and your fiancé(e) have met personally at least once in the last 2 years.
- 4 You and your fiancé(e) have a truly intend to get married after the foreign fiancé(e) comes to the US.
- 5 Your foreign fiancé(e) does not have a serious criminal history. Although not all criminal histories create a problem, please email me the detail of the foreign fiancé(e)'s criminal history so I can confirm.
- 6 Your foreign fiancé(e) has not committed any serious immigration law violation. If you think your foreign fiancé(e) might have violated any immigration law, please email me in detail for a free case evaluation.
- If you and your fiancé(e) meet all the above requirements, your foreign fiancé(e) is most likely eligible for a K-1 visa.
Steps to get K-1 Visa
- 1 You send us your case information for evaluation by clicking the button below.
- 2 If we find any potential problems with your case during our evaluation, we will let you know. If there are no potential problems, we promise to charge only a $800 attorney fee, for which you will receive an invoice and online contract.
- 3 Once you accept the contract online and pay $300 via PayPal, you client file is opened.
- 4 We email you a "Questionnaire" and "Document Checklist" and "Special Prep. Information Package" based on your foreign fiancé(e)'s nationality.
- 5 You and your fiancé(e) fill the entire questionnaire online. You scan and email me all documents on the checklist.
- 6 After completing all required work within 5 days we email you prepared petitions and letter to be signed by you and your fiancé(e).
- 7 You and your fiancé(e) sign the petition and letters and mail them to our office. You also pay for Form I-129.
- 8 We mail the I-129F petition to USCIS on your behalf.
- 9 The receipt notice is delivered within approximately 2 weeks.
- 10 The approval arrives within 3-5 months from the date of filing.
- 11 In addition to preparing the K-1 visa application right after theI-129F petition approval, we email you our "Interview Prep. Information Package" and discuss any potential problems regarding the interview.As soon as the I-129F petition is approved, we will prepare K-1 visa application and email our Interview Prep. Information Package and discuss any potential problem with regard to the interview. The interview package will contain (1) Why interview?, (2) What items you need to bring along for the interview, and (3) Sample questions.
- 12 The K-1 visa will be mailed to the foreign fiancé(e) within a few days after he/she passes the interview.

Embassy visa fee: $240
Attorney fee: $800
Total fee: $1,179 + $100-$400 for a medical exam.
